The Immigration Process

It can be difficult to navigate due to the complexity of U.S. immigration laws, but as a skilled immigration paralegal with many years of experience I may be able to explain in detail the process of filing a petition for a family member who has legally immigrated, as well as the naturalization process, among others. Please be advised that I will do my best to assit you in understanding these processes, however; there may be situations on which you may require the assistance of an immigraton attorney.

Because I have worked Many years with immigration attorneys, and because during all these years I have witnessed how many immigrant cases have bein ruined by people without immigration knowledge like Notarios, I am certain to say that is always safer to have your case done by an Experienced immigration attorney, specially if the applicant has criminal record, or is present in the U.S. without authorization.

the Immigration webpage (USCIS) also acknowledges that some processes can be done by the applicant itself by following the instructions on its site, however to most people these instruction can be a hassle, and therefore to these people I offer the following limited services:

Family Petitions:

Most U.S Citizens and Lawful Permanent Residents are entitled to file a petition for a family member who is legally present in the U.S; has entered with a valid visa, or is living abroad. This petition is commonly known as Petition for a Green Card, and it can be extended to spouses and children, stepchildren, children under 21 and over 21, single or married. Also to parents, steparents and siblings, and half-siblings. Please be advised that there are some restrictions and requirements for each of these petitions which it will be difficult to explain on this page. An applicant living in the U.S with a pending application for Green Card, is eligible to obtain a work permit and a permit to travel while waiting for the Green Card

Who are considered Immediate Relatives (IR)?

Close family members of U.S. citizens: This include parents, spouses, and unmarried children under 21. One benefit of having immediate family members is that they don’t have to wait for a visa number to become available.

Some petitions for family members living overseas may need to wait their turn before obtaining an appointment at the U.S consulates for the Green Card. Read more below.

Family Preference Visas :

Immigrant visas for other than IR (immediate Relatives) are subject to annual numerical limits. Applicants may need to wait several years for their turn (a visa number to become available). Among there are: unmarried adult children of U.S. citizens and, Permanent Residents. Also married children and siblings of U.S. citizens.

Request to Waive Immigration Fees :

The purpose of the Request to Waive Immigration Fees is to help people who are unable to pay the fees needed for the application he/she is filing. People who have proven their inability to pay or have a financial hardship can request a fee waiver by providing the required supporting evidence. Please be advised that the more evidence you provide the better chance you have to get your request approved, however in some cases, the USCIS can deny your request or they can ask you to pay for a reduced fee instead.

Green Card Renewal :

Many people get confused of when is that they need to renew their Green Card or REMOVE THE CONDITIONAL STATUS, so let me explain this a little bit; People who has obtained a Two-Year Green Card, are not yet considered Permanent Residents. This term is usually for those with a 10-year green card and, therefore; in order to apply for the Permanent Resident Card, applicants are required to file a Petition to Remove this Conditional Status. Be advised that the requirements and fee for this process is NOT the same as the ones to renew a 10-year Green Card. On the other side, Permanent Green Cards must be renewed every 10 years to guarantee that you have legal status and, to prevent problems at work or trouble traveling. It is advised to start the renewal process at least six months prior to the expiration date.

Work Permit Renewals:

Work Permit renewals should not be taken lightly because due to its large variety, each one gets their own and unique set of requirements. To applicants in Removal Proceedings my advise is to have their Work Permit renewed with your immigration attorney. I, on the other side, can only offer my assitance for a very few of them.

TPS, DACA, or Applicants with a green card pending are elegible to get a Work Permit and a Permit to Travel

Travel Permit or Advance Parole

The U.S. Citizenship and Immigration Services (USCIS) permits certain non-citizens to temporarily travel outside the United States for urgent reasons like attending a family funeral, obtaining medical treatment, or visiting a sick relative and then re-enter lawfully, without needing a visa. To request a travel permit you must have a pending application for permanent residency or another immigration benefit, like TPS or DACA. IMPORTANT: You must receive approval for advance parole before leaving the United States, otherwise, you may not be allowed to re-enter

Citizenship

Any Lawfull Permanent Resident is elegible to an apply for Citizenship after 5 years of being a Permanent Resident (Green Card holder). People who has obtained their green card through marrying a US citizen, can apply after 3 years. The Immigration Services even accept these petitions 90 days before reaching 5 or 3 years as Permanent Resident.

Fiancee Visas

A fiancé(e) visa allows a foreign national to enter the United States to marry a U.S. citizen. This visa is exclusive to US citizens with not serious criminal record who can prove financial means to support the future spose.

DACA and TPS Renewals

It is very important to follow up the Updates at the USCIS that before hire someone to help you renewing with a DACA or TPS application.
